General Terms and Conditions

§ 1 Scope, Definitions

(1) Richard Grando, Oberer Sattlerberg 9, 94496 Ortenburg, Germany (hereinafter referred to as "we" or "Grando Fine Art") operates an online store for goods and digital products on the website https://richardgrando.com. The following General Terms and Conditions apply to all services between us and our customers (hereinafter referred to as "customer" or "you") in the version valid at the time of the order, unless otherwise expressly agreed.

(2) A "consumer" within the meaning of these terms and conditions is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity. A "business entity" is a natural or legal person or a legally capable partnership that acts in the exercise of its commercial or self-employed professional activity when concluding a legal transaction.

§ 2 Conclusion of Contracts, Storage of Contract Text

(1) The following regulations on contract conclusion apply to orders placed via our online shop at https://richardgrando.com.

(2) Our product presentations on the internet are non-binding and do not constitute a binding offer to conclude a contract.

(3) When an order is placed in our online shop, the following rules apply: The customer submits a binding contract offer by successfully completing the ordering process in our online shop. The order process includes the following steps:

  1. Selection of desired products or digital goods.
  2. Adding the products by clicking the appropriate button (e.g., "Add to Cart", "Add to Bag", etc.).
  3. Reviewing the items in the shopping cart.
  4. Accessing the order overview by clicking the corresponding button (e.g., "Proceed to Checkout", "Go to Payment", etc.).
  5. Entering/reviewing address and contact details, selecting payment method, confirming the GTC and the Right of Withdrawal.
  6. If the agreed condition of the product deviates from usual properties and intended use, confirmation of this condition.
  7. Completing the order by clicking the "Buy Now" button. This represents a binding order.
  8. The contract is concluded when we send an order confirmation via email within three business days to the email address provided.

(4) In case of contract conclusion, the contract is entered into with: Richard Grando, Oberer Sattlerberg 9, 94496 Ortenburg, Germany.

(5) Before placing the order, contract details can be printed via the browser’s print function or saved electronically. Order details, GTC, and the Right of Withdrawal information will be provided via email after you have placed your order. We do not store the contract text after contract conclusion.

(6) Input errors can be corrected using the usual keyboard, mouse, and browser functions (e.g., "Back" button of the browser). Alternatively, you can cancel the order process at any time by closing the browser window and starting over.

(7) Order processing and all related communication will be handled via email. You must ensure that your email address is correct, technically functional, and that receipt of emails is not prevented by spam filters.

§ 3 Subject of the Contract and Key Product Features

(1) The subject of the contract in our online store is:

  1. The sale of physical goods – The specific products available are listed on the respective product pages.
  2. The sale of digital goods – The specific digital products (e.g., software, media downloads) are listed on the respective product pages.

(2) The key characteristics of the goods and digital products can be found in the product description. If the agreed product condition deviates from usual characteristics and intended use, this is explicitly stated in the product description (negative condition agreement).

(3) For the sale of digital products, any restrictions, such as hardware or software requirements, are stated in the product description. Unless otherwise expressly agreed, digital products are intended for personal and business use but not for resale or sublicensing.

§ 4 Prices, Shipping Costs, and Delivery

(1) All prices listed include all applicable taxes and fees, unless otherwise stated.

(2) The purchase price is due before shipment (prepayment), unless we explicitly offer purchase on invoice. The available payment methods are listed in the online shop or on the respective product page.

(3) Additional shipping costs may apply unless a product is marked as free shipping. The shipping costs are clearly indicated during checkout.

(4) Delivery time: Unless otherwise stated in the product description, all offered items are ready to ship within 4 business days after receiving payment.

§ 5 Right of Retention, Retention of Title

(1) You may only assert a right of retention if it concerns claims arising from the same contractual relationship.

(2) The goods remain our property until full payment has been received.

§ 6 Right of Withdrawal

As a consumer, you have a right of withdrawal, which is regulated in our Canellation Policy.

§ 7 Contract Language

The contract language is exclusively German.

§ 8 Liability

(1) Our liability for contractual breaches and torts is limited to intent and gross negligence, except in cases specified below.

(2) We are fully liable for injury to life, body, or health, and for breaches of essential contractual obligations. In case of slight negligence, liability is limited to foreseeable, typical damages. . .

(3) If a customer fails to install updates for digital products that were provided and communicated, we are not liable for defects resulting from the lack of updates.

§ 9 Warranty

(1) Warranty is provided in accordance with legal provisions.

(2) For business customers, the warranty period for delivered goods is 12 months.

(3) Consumers are requested to check products immediately after delivery for completeness and defects. Failure to do so does not affect legal warranty claims.

§ 10 Final Provisions / Dispute Resolution

(1) German law applies. For consumers, this applies only insofar as no mandatory consumer protection laws of their home country are affected.

(2) The UN Sales Convention (CISG) does not apply.

(3) Jurisdiction: If the customer is a business entity, the place of jurisdiction is our registered business location.

(4) Online Dispute Resolution (ODR): The European Commission provides an online dispute resolution platform (ODR) at https://ec.europa.eu/consumers/odr.
